Kewenangan Pemerintah Mewajibkan Vaksinasi COVID-19 terhadap Warga Indonesia dengan Alasan Kedaruratan Kesehatan

Abstract

Penelitian ini hendak membahas tentang kewenangan Pemerintah mewajibkan vaksinasi covid-19 sebagai upaya penanganan pandemi dalam rangka perlindungan terhadap kesehatan publik. Dalam situasi normal, Pemerintah tidak memiliki kewenangan tersebut karena terbentur dengan hak individu untuk memilih layanan kesehatan bagi dirinya sendiri. Penelitian ini berargumen bahwa Pemerintah memiliki kewenangan untuk mewajibkan vaksinasi covid-19 sehingga terjadi derogasi atas hak individu untuk bebas memilih layanan kesehatan tersebut karena pandemi covid-19 telah ditetapkan statusnya sebagai kondisi “Kedaruratan Kesehatan”. Kondisi kedaruratan tersebut memenuhi kriteria untuk dikualifikasikan sebagai public emergency threathens the life of the nations, sehingga Pemerintah dapat melakukan tindakan derogasi. Atas dasar itu, karena kondisi Kedaruratan Kesehatan, Pemerintah memiliki kewenangan mewajibkan vaksinasi covid-19 kepada warga Indonesia yang berbeda dengan kebijakan vaksinasi yang sedang berjalan sekarang ini.

This study wants to discuss the Government's authority to require covid-19 vaccination as an effort to handle the pandemic in the context of protecting public health. Under normal circumstances, the Government does not have that authority because it is bumped with an individual's right to choose health services for himself or herself. This study argues that the Government has the authority to require covid19 vaccination so that there is a derogation of the right of individuals to freely choose these health services because the covid-19 pandemic has been designated as a condition of "Health Emergency". The emergency condition meets the criteria to be qualified as a public emergency threatens the life of the nations, so that the Government can take derogation measures. On that basis, due to the health emergency, the Government has the authority to require covid-19 vaccination to Indonesians which is different from the current vaccination policy.
