Abstract: The first ethical obligation that comes from the categorical imperative of the good and free will is the free and good will to protect human life. It is because the human life is the basic for all human activities including moral intelectual activities. In other words, all human activities presuppose human life essentially and existentially. When is the first time of life or the time of ensoulment? According to the latest finding from the field of biology, embryology and genetics, the human life starts directly after the conception process finished. Hence, the protection of human life must start directly after the process of conception is finished. The act to protect human life as a categorical imperative presupposes also that the subject has the correct understanding about three fundamental knowledges: the abortion, the embryo, and the time of ensoulment. Then, followed by the categorical imperative in protecting human life since the beginning, an abortion has to be rejected. In order to know if an ethical perception is constructed by that categorical imperative or not, there are two aspects that can be used as the indicators. First is how the dynamics of free and good will that animated the subject. This depends on the quality of the understanding of the three fundamental knowledges and if there is one or more heteronomous factors. Then the basic arguments above are used to analyze the construction of ethical perception about abortion of the respondents. The result is that there is not any respondent who constructed their own ethical perception about abortion based on the true free and good will. This means also that there is not any respondent who is in the sixth stage of the moral development according to Lawrence Kohlberg. There are two influence aspects in the construction of their perception. First is the fact that all respondent did not have understanding of one or two or all of the fundamental konowledges, especially about the time of ensoulment. The second is the fact that there are five heteronomous factors influenced the respondents. The most influential factor is the interaction and relation in their own family life. Therefore, in answering the necessity for the formation of ethical perception about abortion according to the theories used in this research and the concrete situation of respondents founded from the research, I suggest two actions. Firstly, there is need to socialize the three fundamental understandings. Secondly, it is the formation about the family's value
